Legal actions against acc owner
Hello,
a friend of mine sold an account many years ago, it was nothing fancy, but now he is thinking about comming back to the game and obviously he is too lazy to level new toons etc.
They made some kind of security agreement with the guy who bought the account (reseller) about eventuall recall of the account (signed contract, some id photo etc).
The question is is it safe for him to recall it ?
Is the reseller able to take some legal steps after him for getting it back (unless the guy who actually bought it isnt playing/aint gonna try to getit back via reseller)?

If your friend were to take the account back, the current user would just take it back again because he would have the same proof as your friend, unless your friend can proove that he was the one who Bought the account etc.
I wasn't gonna mention this but i will.
Selling an account then to take it back after awhile is a DICK Move, your friend is a DICK and he deserves to lose that account.

Yeah I told him the same, completly agree with you on that point.
What about the reseller's position ? Im just quite worried about my friend even tho he is a dick.

What expansion did he quit during? I ask because of character boost to level 100. Buy Legion, get level boost, get less of a headache.

This contract is useless because your friend doesn't own the account, Blizzard do. If you were to try legal action Blizzard would most likely be cited in and the account would be banned. It's like you buying a rental car but lending it to someone with a contract, it just doesn't make any sense.
From Blizzard's T&C:
Ownership.
All rights and title in and to the Service (
including without limitation any user accounts, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, “applets,” transcripts of the chat rooms, character profile information, recordings of games)
are owned by Blizzard or its licensors. The Game and the Service are protected by United States and international laws, and may contain certain licensed materials in which Blizzard’s licensors may enforce their rights in the event of any violation of this Agreement.

it depends where you live. if he does this for example in germany or italy, hes fucked. i was an account seller back then ... so yeah, there were a few guys and my uncle (lawyer here in germany) wrecked them. blizzards "terms of use" isnt worth a sh*t in most countries.

In my country, yes. I've told you before that what your 'friend' wants to do is very wrong, and if he goes through with it I hope the current owner of the account gets back at him good.

Thanks for all the replies. I managed to convince him that it isn't the best idea and we will raf together, since the 7.3 is tomorrow he will quickly catch up with everyone.
And please, u don't have to be that rude and assume the worst, I know it is THE internet, but hey, we are all humans and sometimes there's no back story.
