Can I get banned if...

I have 2 accounts on different battle net accounts, both have duped items on them

I had all of the items on one account but I traded some to the second

If I only sell items on 1 account can they both get banned or would the one with no sales be safe?

Also is it safe for both to be in the same guild

The same IP address has been used for both accounts

They can ban you for anything they want.

If you have duped on both accounts then it could probably be banned to. who knows

Yeah, there is always a risk for that, but usually they only ban the account you dupe/bot/exploit etc on, but on serious stuff they can also ban all accounts connected to your IP.
