Is there anyway to get the last name off a scammed account? without calling blizzard?

Correct. There is no actual surefire method other than asking the person for their last name (if they're the original owner). You cannot call up and ask for the last name. There is no way to learn or otherwise retrieve the last name of the account from Blizzard.

Yes, this is indeed a good thing. I recommend pretending you know them, essentially. From their account, look at their city/address. Say "hey do you live in X town?" Ask for their first name. If it's Joey. "Wait a minute, Joey!? Joey who? I think I might know you!" So, they think you actually live near them, so they'll give their last name.

To test their last name, create a trial account with that last name and try to transfer a character to that account. If an error message comes up saying "transfer ineligible", then the last name is wrong.

If an error comes up saying "cannot transfer to trial accounts", then the last name is right.

This is because the system does a last name check before it does a trial account check.
