i think there are other factors that affect getting banned. example of this is if someone reports you then niantic checks your gameplay log.

If you used Haxton, 100% ban. They must be keeping stats on our accounts like exp earned on which days, like your cell phone online account. So any account that used a bot like Haxton will be 100% banned. If you used Necro then it depends on your settings, but any kind of fast leveling should be flagged.
