Well, here's the thing, if you say you are banned and want a refund, it's not going to happen. If you admit that you want a refund, because you can't play anymore on a banned account.
Your best option is to go to Google Play Store and request a refund. Probably the 2 day window has already expired, so you might have to contact customer services directly, if the direct method fails. And tell them, you have been getting a login server error, for a few days, which completely prevents you from playing Pokemon and when directly contacting Niantic (through normal customer services, not the ban appeal) you have not gotten any reply to help you out, solving the login issue. Therefore you request a refund.

While I do not disagree per se, how do you actually know it is a banned/closed account if they do not tell you?
There is nothing on their web site which states the "error" message is related to a ban or closed account.
You wake up one day and get "Failed to get data from Servers".
Niantic is not sending you a notification that your account has been banned/closed for violating their terms of service.
You are just perpetually unable to login with a message that could also mean the servers are down.
I am going to try and get some money back as I have submitted a report a problem ticket to Niantic (not a ban appeal) and have not heard back from them. If they tell me my account has been banned, that is different, but right now, they just shut me down with no explanation at all.
It is their process that is flawed right now. If you are going to ban accounts of paying customers, the account needs to be notified.

Hello, to help you some, i would recommend that you first email them and tell that it was a relative (preferably your brother or something) tell them that they did it...but this didnt work for me, so i called them and then i manage to get a refund on my purchase!so i think calling in is a bigger chance of success! you can still get your money back. just go to play and submit unauthorized purchase. i got 20 dollars in about an hour. **** you niantic
