Buying Games on a Stolen XBL Gamertag. Couple Questions

Ok, so I have an account, which isn't mine that has 5000 MS Points.

I'd like to purchase a couple games for MY Xbox 360, however... how do I go about this? Do I recover his gamertag on my console, buy games and they will save onto my Hard Drive?

I WANT to be able to play them with MY gametag, not the stolen one. How do I go about this?

Its all linked to his gamertag, there is no way to change that.

Ive done this a few times. For some games it works, you can recover it, buy them then delete the gamertag. But for some games when you buy them you can only play them on that gamertag. Like a game you can get is Castle Crashers and a game you cant is Watchmen.

Not true, I've recovered my friends gamertag to download a bunch of his rockband songs and when he signed online it made the content stop working on my main gamertag.

The games are bound to your console ID. So yes, you can.
