This is not to show an exploit more so than to discuss whether exploiting is bannable or not.
Guess what, according to the EULA, the only bannable exploit is item duplication, meaning every exploit is a nonbannable offense.

This License Agreement is effective until terminated. You may terminate this License Agreement at any time by providing notice to Blizzard customer service via email at [email protected], at which time Blizzard will remove your license to use the Game from the Account. Blizzard may terminate this Agreement at any time for any reason or no reason. Upon termination, all licenses granted herein shall immediately terminate and you must promptly remove the Game from your hard drive.

It doesn't say any such thing. Read it again and it lists all things that are against the rules, but no where does it define the punishment for those transgressions.
