That's only if the person who owned the account contacted blizzard, but yes if it's a scammed account your main could and will be in risk of a ban if the OO does do something about it. Now, If it's your account and you have all the info such as CD key, email, First and last name, SQ and all that you'll be fine. If you have some but most, theres a chance it won't work but also a thin chance it will.
