transferring scammed to a new account

Just wondering if this makes it any better, or less likely to be restored to original owner?

If you transfer it to a new account and ban the old then it's your character. So you can sell it save and the original owner can't do a thing because his account is banned.
So if you scammed a good account with all info needed for transfer. Buy a battlechest and transfer and sell
