If Blizzard thinks it's a scam, it's a scam, and you get in trouble. Their is no "Oh but we didn't do this so we can't get banned" if Blizzard thinks you scammed him, you did, deal with it.

7. Blizzard’s Absolute Right to Suspend, Terminate and/or Delete the Account.
BLIZZARD MAY SUSPEND, TERMINATE, MODIFY, OR DELETE THE ACCOUNT AT ANY TIME WITH ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE. For purposes of explanation and not limitation, most account suspensions, terminations and/or deletions are the result of violations of this Terms of Use or the EULA.
If they don't think you scammed, but want to give you consequences anyway, well they can. Another thing that you're going to have to deal with, and they don't care what you think, because they had the rights to do it.
