hi if im hacking and i duo with a non hacker can the non hacker get banned?

Durr, yes. Will they? Who knows. They would have to be reported, which is up to the person reporting you to toss their name into the mixer.

edit: could add in, that if you Duo exclusively with that person and their rank goes up because of it, then chances are if you are banned for hacking, Blizzard would find out their account was enhanced by your hack-wins and therefore ban them or reset their account... Whatever it is they do.

Durr, no they wouldn't. Mayby get your rank reset but not banned, all you did is play with some you could have not known was cheating.
