Need help with frames per second and hardware (Gears of War, other games)

So to start this off as quick as possible, my problem is that i'm not getting 55-60 FPS with my System hardware, which matches the minimum requirements and surpasses beyond it, to my belief.

The Minumum requirements for GoW, i match them...but for the processor it says "2.4+ ghz Intel." Does this mean 2.4 and up single core, or dual core? Here are my computer specs:

Ultra X3 800w PSU

Intel DG965WH Mobo

Intel Core 2 Duo E4400 (2.0 ghz)

BFG 9800 GTX OCX

4gb of 800 mhz OCZ RAM

On board sound.

Now i'm only getting between 35-45 on AVERAGE, thats not when theres a huge amount of gunfire. Is there anything that catches anyones eye that could be the problem? Thanks in advance

Another game, Team Fortress 2, for example...i'm only getting around 30.

oh...And i already did update all my video card drivers, so thats not the issue >_>

I have quite the same problem, i don't get over 60fps, i can run 2 games with each around 60 fps but not anymore fps.
Quad Core 4*2,4ghz
8800Gts, 4Gb Ram

i dont get over 60 fps on most new games with my two 8800gts either, but i dont really mind. only thing i hate is on GRID i only seem to get 30ish on average, quite annoying... from what i can spot from your system, your processor is a tad slow but thats about it..
