Can you get banned for scamming in diablo 3?

So yeah, i was wondering , is it ban-able ?

What i was thinking like was these promise scams where a person gives you X gold in return for something they might not get.

    Is it banable ?

Ofc. You can get banned just for writing the wrong sentences. My friend got one for saying the middle east shouldn't learn how to fly as it posed a danger to all of us. That was all it took and he was banned perm. So it must be said, he got _some_ punishment.
I got banned in Wow for scamming as well, sooo.. It all comes down to whether the person reports you

your friend got banned for racism/nationalism, that is justified ban, and its not related with scaming at all.

In diablo 2, there was NO options to report them easily. And when you wanted to contact a GM, you could do so in a one hour time slot on a specific channel on the US servers. In D3, you can rightclick peoples names and there are report options <.< Besides, you could join public baal runs that were hosted by a hammerdin bot, and you could do nothing to report it. They honestly banned no one in D3, whether they botted or hacked, unless they were autodetected by Warden.

But perhaps, they might not be so anal and ban people for BM and scamming, it would just seem so, granted that they are very strict at catching botters etc, and given its a new game they want to give people a good start in.

so geberally - banable? Of course. Will you get banned? Don't think so. this whole post seems like a way for them to 'not to have to deal with scammers. You get scammed? Your own fault, kthxbb.".

Stated from Blizzard themselves.. they said they are not responsible for items you lose. You are encouraged to do your trading on the Auction Houses or use our Secure Trade Window. If this player has upset you in anyway, we apologize. We currently do not keep records of any trades done in game. Sorry for the inconvenience.

They have some kind of ToS stating about scamming, where they clearly say.. we don't care.
